It is with regret that I need to inform you that some members have or had obtained the services of an attorney.

Therefore, it has become necessary for the ATFTC Board to do likewise.  For your information, Barbara Quast has filed in the state of New York.  We have now retained lawyers in the states that will be affected; NY, OK, CA, and WA.  You are free to call me at 405-732-1873 if you choose.  I will attempt to keep you informed as to the progress via the President's Reports section on our Website.  We were waiting to confirm a law suit had been filed before obtaining lawyers. 

As explained in the e-mail below, additional members have or had retained the services of a lawyer.  To explain why no response to those listed below was given, once you receive something from an attorney, you must not respond, your lawyer needs to respond to their attorney.  Please read the email we received below on the 16th of October 2009.

Be advised that I have been retained by members of the America Toy Fox Terrier Club of America, Inc., to insure that there is a democratic, fair and impartial election conducted pursuant to the American Toy Fox Terrier Club of America, Inc.'s Constitution, By-Laws and the Statutes of the State of Washington.  Four members in "good standing" have scrupulously submitted their candidacy for election to the Board as is their legal right and privilege as members of the American Toy Fox Terrier Club of America, Inc.  Those four members are:

             Denise Monette, running for President

             Gary Beeler, running for Treasurer

             David O'Suna, running for the  Board

             Ann Walton, running for the Board

 

Yes, we assume they are still represented by the attorney as we have received nothing to the contrary.   

With all the rumors and untrue statements, it appears they all will have to be addressed in the court room.  This means the possibility of our treasury being depleted.  The officers and Board members are insured for such situations and hopefully ATFTC monies will not be affected.  I personally have fronted the monies thus far.  I can assure you this board will take all steps necessary to protect the ATFTC.

I can assure you this Board has done everything possible to stay within the guidelines of the Constitution and By Laws and have corresponded with AKC continually. 

The monthly financial statements are on our Website for your review.  All the money is accounted for and all expenditures have receipts.

Again, I am sorry for the bad news, but it will be resolved.  Check the President's Reports section for updates on the progress.
